PLEASE READ THE FOLLOWING TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING THIS WEBSITE. All users of this site agree that access to and use of this site are subject to the following terms and conditions and other applicable law. If you do not agree to these terms and conditions, do not use this site.

Returns & Cancellations

Cancellation
Your order may be cancelled up to the time that it has been processed for shipment. Once it has been processed it cannot be cancelled. If you find you need to cancel please call us immediately (413) 536.5551 or email cancellations@mckenneyelectric.com

Modifying an order

We are unable to modify an order after it has been placed. We are not able to add to an existing order, you will need to place a new order.

Returns

Most parts have a 30-day return period. All returns are subject to a 15% restocking fee. The original shipping charges will not be refunded. We will help you in any way possible to process a claim. Some manufacturer’s will not reimburse for shipping costs for returned parts and some will ask that the parts be sent back to the factory for testing, which can take about 3-4 weeks. A RMA will be emailed to you. Print a copy and include in the box with the part(s) you are returning. Refunds are typically issued within 1 week after the part is received in our warehouse.

All returns must be sent back pre-paid, with a tracking number, in the original packaging and unused. We do not reimburse for any fees that you incur to send the product back to us. Please insure your items. If they arrive at our warehouse damaged we cannot issue you a refund. All products will be inspected before a refund will be issued, if the product is not in original, unused condition, you will not receive a refund. Returns without a RMA may be charged a 20% restocking fee. Any order that is refused will be charged a 20% restocking fee.

Product Warranty
Most products carry a warranty. Due to their sensitive nature, many electronics carry a 30 day warranty. If you find a product to be defective in this time period please contact us for return instructions. You are responsible for the cost of returning the defective product to us for testing. We will cover the cost of sending you a replacement product via ground shipping. Under warranty replacement you will not receive a cash refund, we will replace the product if it is proven defective. If a product is determined “good” with no defect there will be a flat $20 fee for return shipping of the item and diagnosing the part. OEM parts are covered under the manufacturer’s warranty. If a part is installed in a brand or model other than what is listed in the part description the warranty will be null and void. Any tampering or modifications to a part or product also voids the warranty.

Shipping
We use UPS for shipping. Once your order has been shipped you will receive an email with the tracking information. You can also log into your account to check order status. Shipping time frame can be found on the product that you ordered. This is the amount of time we need to pack the item before it leaves our warehouse. Please also add in transit time, (typically 3-5 business days). If your order contains multiple items please reference the longest lead time given. We do not split ship orders, if one item is on backorder your order will be held until all parts are in stock.

Damaged Items

If your item was damaged during shipping please contact us immediately. Damage must be reported within 2 days of receiving the item. You will be asked to send us photos of the damaged item, and the packaging it was received in. We will file a shipping claim and send you replacements.

Restocking Fees

All returns are subject to a 15% restocking fee. Returns received without proper paperwork or an RMA number, or returns sent to the incorrect address will be charged a 20% restocking fee. Any order that is refused will be charged a 20% restocking fee.

Backorders
In the event that a product is on back order the customer will be notified and given the option of canceling their order or waiting for the product to arrive. We make every effort to keep our site updated with back order information, however we may occasionally miss something.

McKenney Hearth & Home does not represent or warrant that the functions contained in the site will be uninterrupted or error-free, that the defects will be corrected, or that this site or the server that makes the site available are free of viruses or other harmful components. McKenney Hearth & Home does not make any warrantees or representations regarding the use of the materials in this site in terms of their correctness, accuracy, adequacy, usefulness, timeliness, reliability or otherwise. Some states do not permit limitations or exclusions on warranties, so the above limitations may not apply to you.

Limitation of Liability
McKenney Hearth & Home shall not be liable for any special or consequential damages that result from the use of, or the inability to use, the materials on this site or the performance of the products, even if McKenney Hearth & Home has been advised of the possibility of such damages. Typographical Errors
In the event that a McKenney Hearth & Home product is mistakenly listed at an incorrect price, Mountain View Hearth Products Inc. reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. McKenney Hearth & Home reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, McKenney Hearth & Home shall issue a credit to your credit card account in the amount of the incorrect price.

Term; Termination
These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by McKenney Hearth & Home without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

Miscellaneous
Your use of this site shall be governed in all respects by the laws of the state of Massachusetts, U.S.A., without regard to choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of McKenney Hearth & Home products) shall be in the state or federal courts located in Massachusetts. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of McKenney Hearth Home products) must be commenced within one (1) year after the claim or cause of action arises. McKenney Hearth & Home’s failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. McKenney Hearth & Home may assign its rights and duties under this Agreement to any party at any time without notice to you.

Use of Site
Harassment in any manner or form on the site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including a McKenney Hearth & Home or other licensed employee, host, or representative, as well as other members or visitors on the site is prohibited. You may not upload to, distribute, or otherwise publish through the site any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law.
